Council Minutes

Did you realise that the Council Minutes are the legal evidence of the Council's business. According the Local Government Act 1993:

Section 703 Minutes

"Every entry in the minutes of the business transacted at a meeting of the council and purporting to be signed by the person presiding at a subsequent meeting of the council is, until the contrary is proved, evidence:

(a) that the business as recorded in the minutes was transacted at the meeting, and

(b) that the meeting was duly convened and held.

Therefore, running a system that electronically manages the Council Minutes does not meet the requirement of being "signed by the presiding person at a subsequent meeting of the council".  The only true record of evidence is the hard-copy document that is signed.  These software applications are designed to manage the action items and process of creating the Council Minutes prior to a Council Meeting.  They were never designed to manage the signing process and consequential official record.

To minimise the litigation risk of your Council you should have a hard-copy record that is signed.  Once signed it can be scanned and bound.  Therefore creating both a hard-copy and electronic copy of the signed business record.
